These terms and conditions apply to all online offers, orders, sales transactions, and deliveries via the Idemax webshop. Deviations only apply if they have been confirmed in writing by Idemax.
3. Offer and Product Information
3.1 The online offer is non-binding and can be changed or withdrawn by Idemax at any time.
3.2 Idemax strives for correct and up-to-date product information, but errors or mistakes in images, specifications, or prices do not bind Idemax.

4. Conclusion of the agreement

4.2 Idemax reserves the right to refuse an order, for example, in case of payment problems or stock shortages.
5. Prices
5.1 All prices are displayed in euros and excluding VAT, unless otherwise stated.
5.2 Transport costs, installation costs, or other additional services are indicated separately.
5.3 Idemax can adjust prices at any time; the price applicable at the time of ordering is decisive.
6. Payment terms
6.1 Online orders must be paid for according to the payment methods offered on the webshop (Bancontact, bank transfer, online payment, etc.).
6.2 Orders will only be processed after full payment, unless otherwise agreed.
6.3 In case of late payment, the following amounts are automatically due without notice:
- the statutory interest,
- a fixed compensation in accordance with legislation on payment delays in commercial transactions.
7. Delivery
7.1 Delivery times areindicative; delays cannot give rise to cancellation or compensation.
7.2 Delivery occurs at the address provided by the customer.
7.3 The risk transfers to the customer upon physical receipt of the goods.
7.4 If delivery proves impossible due to incorrect information or an inaccessible location, Idemax reserves the right to charge additional costs.
8. Right of withdrawal (if applicable)
Note: many Idemax products are made to order. For custom products, there is no right of withdrawal..
8.1 For standard products that are not custom-made, the consumer has a right of withdrawal of 14 days after delivery.
8.2 The product must be returned undamaged, unused, and in its original condition.
8.3 Return shipping costs are always the responsibility of the customer, unless otherwise agreed.
8.4 Idemax will refund within 14 days after correct receipt of the returned products.
8.5 The right of withdrawal does not applytothe following:
- products made according to customer specifications;
- products that cannot be resold due to personalization;
- goods that by their nature cannot be returned.

9. Complaints and Conformity
9.1 The customer must report visible damage or non-conformity immediately upon delivery and confirm in writing within 48 hours at the latest.
9.2 Other complaints must be reported in writing within a reasonable time.
9.3 Idemax will first offer repair, replacement, or an appropriate solution.
10. Warranty
10.1 Idemax offers a warranty in accordance with the Belgian legal provisions..
10.2 The warranty applies only to construction and manufacturing defects, not to:
- normal wear and tear;
- damage due to incorrect use, vandalism, or insufficient maintenance;
- installation by third parties that was not carried out according to the guidelines.
11. Cancellation of orders
11.1 An order placed can only be canceled with written approval from Idemax.
11.2 In case of cancellation of custom work, up to 100% of the order amount may be charged.
11.3 For standard products, a flat fee may be charged (min. 20% of the order amount).

All delivered goods remain the property of Idemax until the customer has paid in full..
13. Specific Conditions for Play Equipment, Play Panels, and Combinations
13.1 Safety Standards & EN1176
Play equipment, parts, and combinations are designed or manufactured, where applicable, according to the applicable European standards, including EN1176..
The customer remains responsible for correctly interpreting, applying, and complying with the standard, including:
foundation requirements
fall heights
impact-absorbing surfaces
required free spaces
installation and inspection procedures.
13.2 Customer Responsibility
The customer is responsible for:
The suitability of the ground;
The presence or installation of a compliant impact-absorbing surface if legally or technically required;
Regular inspections and maintenance according to EN1176 and local regulations;
Correct use according to the age and capacity guidelines of the equipment;
Providing a safe, free fall zone around equipment.
If the customer fails to comply with the above obligations, Idemax cannot be held liable for any damage, injury, or defects arising from this.
14. Placement and Installation

The customer ensures smooth accessibility, a cleared area, and a safe working environment;
Any additional work due to unforeseen circumstances (e.g., unstable ground, obstacles, utility lines) will be charged separately;
After installation, the customer will receive instructions for use, inspection, and maintenance.

15. Liability

15.3 Idemax is not responsible for damage caused by:
- incorrect assembly by the customer or third parties
- lack of maintenance
- non-conforming ground
- use outside the recommended age category
- incorrect application of EN1176
16. Intellectual Property
All designs, drawings, texts, product descriptions, and images remain intellectual propertyfrom Idemax and may not be reproduced without written permission.
17. Force Majeure
In the event of force majeure (such as material shortages, strikes, transport problems, extreme weather conditions, etc.), Idemax may suspend or cancel the agreement without compensation.
18. Privacy
Idemax processes personal data in accordance with GDPR legislation.

19. Applicable Law
